In some cases, it may take longer for the funds to appear in your account.)

• To the extent permitted by mandatory consumer law, Livingstone Holiday's liability is limited as follows:
  • Any mistakes in email addresses, phone numbers, or addresses or GST number are not our liability.
  • Events beyond our control or force majeure events are not within our liability.

  • Fraud or fraudulent misrepresentation.
• Livingstone Holiday does not make any promises regarding the products and services of Service Providers, except as expressly stated in these Terms. It is your sole responsibility to make informed choices.
• You may be protected by mandatory consumer protection laws and regulations, which supersede any company's terms. In such cases, our liability is determined by these Terms and applicable consumer protection laws and regulations.

Indemnification

You agree to indemnify and hold Livingstone Holiday and its affiliates, agents, directors, employees, and partners harmless from any claim, demand, or damages, including reasonable attorneys' fees, arising out of your use of the Website or your violation of any rights of a third party.

Jurisdiction

Any dispute arising out of or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts located in Chandigarh, India. You agree to submit to the personal jurisdiction of the courts in Chandigarh for the purpose of resolving any such dispute.

Livingstone Holiday does not engage in fake calls, phishing, spamming, or any fraudulent activities. If you receive any communication claiming to be from Livingstone Holiday and suspect it to be fraudulent, please report it immediately to support@liviingstonestays.com

Measure against unacceptable behaviour

• Livingstone Holiday reserves the right to take necessary actions, including but not limited to the following, if we determine, at our sole discretion, that you have engaged in unacceptable behavior:
  • Terminate your ability to make any bookings.
  • Cancel any bookings you have already made.
  • Suspend your access to our platform, customer service, and/or your account.
• We exercise these measures if we believe, in our opinion, that there are valid reasons, such as:
  • Fraudulent activities or abuse.
  • Non-compliance with our values, applicable laws, or regulations.
  • Inappropriate or unlawful behavior, including violence, threats, or invasion of privacy directed towards Livingstone Holiday, our partners, or any other individuals.
• In the event that we cancel a booking due to unacceptable behavior, you will not be entitled to a refund. We may provide you with the reason for cancellation unless it would violate applicable laws or obstruct the detection or prevention of fraud or other illegal activities. If you believe that your booking has been incorrectly cancelled, please reach out to our Customer Service team.

User’s Responsibility
